▪▪▪ English versionWalkers Experience is a 7 to 15-day trip to a destination chosen by the applicant, accompanied by a Walker community host and, potentially, other members. The activity may include long-duration hikes, extreme or irregular terrain, variable altitude, changing weather conditions, local transportation, and extended time spent with people the applicant has not previously met.
The applicant expressly acknowledges that this activity carries inherent risks, including without limitation: physical injury (ranging from minor to severe), exhaustion, altitude sickness, adverse weather conditions, transportation accidents, and risks arising from interaction with the host and other community members. The applicant declares that they participate voluntarily, assuming such risks with full knowledge of their nature.
The applicant declares that they are in adequate physical and health condition to participate in the described activity, and agrees to inform Walkers, prior to the trip, of any relevant medical condition (including allergies, treatments, or physical limitations) that could affect their participation or the response to an emergency. The applicant declares that they hold valid travel medical insurance with coverage adequate for the duration and nature of the trip, as a condition of participation.
In the event of a medical emergency during the trip, and where it is not possible to obtain the applicant's consent in a timely manner, the applicant authorizes the host and Walkers staff to request and coordinate the emergency medical care reasonably deemed necessary, with costs of such care to be borne by the applicant or their travel medical insurance.
To the maximum extent permitted by applicable law, the applicant releases Walker Social Club, OSIRIS LUXURY EVENTS, S.A. DE C.V., its hosts, staff, and representatives from liability for injury, damage, or loss arising from the inherent risks of the activity described in this document.
This release does NOT apply to, and in no case exempts Walkers from liability for, willful misconduct, bad faith, or proven gross negligence of its staff or representatives, as provided under Mexican law (Federal Civil Code) and equivalent principles in other jurisdictions.
Walkers conducts a selection process for hosts within the community, but does not guarantee the conduct of such hosts or other participating members. The applicant releases Walkers from liability for disputes, conflicts, or third-party conduct occurring during the trip, without prejudice to Walkers' obligation to exercise due diligence in the selection and training of its hosts.
This waiver does NOT release, and is not intended to release, Walkers/Osiris from its liability as a package travel organizer under Directive (EU) 2015/2302, regarding the proper performance of the transport, accommodation, and meal services included in the trip. Such liability is mandatory for European Union applicants and cannot be waived by contract. This document is limited to the physical and third-party conduct risks described in Sections 1 through 6.
The applicant authorizes Walkers to capture and use photographs or video of the trip for community promotional purposes, unless expressly stated otherwise before the trip begins.
This document is governed by the laws of the United Mexican States, without prejudice to the mandatory consumer and traveler protection rights applicable to the applicant under the laws of their country of residence, which shall prevail in the event of conflict.
Acceptance of this document via the corresponding checkbox on the application form constitutes valid electronic signature and full consent to its terms.
Walkers Experience es un viaje de 7 a 15 días a un destino elegido por el aplicante, acompañado por un anfitrión de la comunidad Walker y, potencialmente, otros miembros. La actividad puede incluir caminatas de larga duración, terreno extremo o irregular, altitud variable, condiciones climáticas cambiantes, transporte local, y convivencia prolongada con personas que el aplicante no conoce previamente.
El aplicante reconoce expresamente que dicha actividad conlleva riesgos inherentes, incluyendo sin limitar: lesiones físicas (desde leves hasta graves), agotamiento, mal de altura, condiciones climáticas adversas, accidentes de transporte, y riesgos derivados de la interacción con el anfitrión y otros miembros de la comunidad. El aplicante declara participar de forma voluntaria, asumiendo dichos riesgos con pleno conocimiento de su naturaleza.
El aplicante declara encontrarse en condiciones físicas y de salud adecuadas para participar en la actividad descrita, y se obliga a informar a Walkers, previo al viaje, cualquier condición médica relevante (incluyendo alergias, tratamientos, o limitaciones físicas) que pudiera afectar su participación o la respuesta ante una emergencia. El aplicante declara contar con seguro médico de viaje vigente y con cobertura adecuada para la duración y naturaleza del viaje, como condición para su participación.
En caso de emergencia médica durante el viaje y de no ser posible obtener el consentimiento del aplicante de forma oportuna, éste autoriza al anfitrión y al personal de Walkers a solicitar y coordinar la atención médica de emergencia que razonablemente se considere necesaria, corriendo los costos de dicha atención por cuenta del aplicante o de su seguro médico de viaje.
En la máxima medida permitida por la ley aplicable, el aplicante libera a Walker Social Club, OSIRIS LUXURY EVENTS, S.A. DE C.V., sus anfitriones, colaboradores y representantes, de responsabilidad por lesiones, daños, o pérdidas derivadas de los riesgos inherentes a la actividad descrita en este documento.
Esta liberación NO aplica, y en ningún caso exime, a Walkers de responsabilidad por dolo, mala fe, o negligencia grave comprobada de su personal o representantes, conforme a lo establecido por la legislación mexicana (Código Civil Federal) y los principios equivalentes en otras jurisdicciones.
Walkers realiza un proceso de selección de anfitriones dentro de la comunidad, pero no garantiza la conducta de dichos anfitriones ni de otros miembros participantes. El aplicante libera a Walkers de responsabilidad por disputas, conflictos, o conductas de terceros ocurridas durante el viaje, sin perjuicio de la obligación de Walkers de actuar con debida diligencia en la selección y capacitación de sus anfitriones.
Este deslinde NO exime, ni pretende eximir, a Walkers/Osiris de su responsabilidad como organizador de paquete de viaje conforme a la Directiva (UE) 2015/2302, respecto del correcto desempeño de los servicios de transporte, hospedaje y alimentación incluidos en el viaje. Dicha responsabilidad es de carácter imperativo para aplicantes de la Unión Europea y no puede renunciarse por contrato.
El aplicante autoriza a Walkers a capturar y utilizar fotografías o video del viaje con fines promocionales de la comunidad, salvo manifestación expresa en contrario antes del inicio del viaje.
Este documento se rige por las leyes de los Estados Unidos Mexicanos, sin perjuicio de los derechos imperativos de protección al consumidor y de viajero que correspondan al aplicante conforme a la legislación de su país de residencia, los cuales prevalecerán en caso de conflicto.
La aceptación de este documento mediante el checkbox correspondiente en el formulario de aplicación constituye firma electrónica válida y consentimiento pleno a sus términos.
